You could learn to model it yourself (low poly if you want to use it in LayOut, or high poly for render)

You could also contact the manufacturer and see if they provide models for interior designers
You’re only partially right. Undoubtedly, someone modeled on this product, but the way of upholstery, legs and proportions differ enough that if you started producing such chairs, the original manufacturer would have no reason to accuse you of plagiarism. 
That’s a whole other can of worms 
Yes, once you could say that I was quite deep in this tin… Constant e-mails to agree on a difference of 0.1 mm in the rounding radius… One of the reasons I abandoned it.
